Felony Hit And Run Criminal Attorney

A skilled felony hit and run criminal attorney with 30 years experience, David Pflaum asserts the rights of his clients and gets the best possible results for them in court.

Just because a person is accused, cited or arrested for a crime does not mean that he or she is guilty.  The accused has rights and remedies.

Definition.  An accusation of hit and run in violation of Vehicle code section 20001 involves an allegation that a driver was involved in an accident, failed to stop at the scene, and another person was injured.

The accusation is considered a felony punishable by up to three years in prison.

Get Out Of Jail.  Felonies are the most serious types of criminal accusations.  Almost every person accused of a felony is arrested and put into jail with bail set according to the San Diego County Jail schedule.

There are many ways an experienced defense lawyer represents his client, beginning with talking to him or her about the facts of the case during an initial consultation and finding out the client’s version of what caused the legal problem to arise.

Every case is different.  Every client is unique.

An experienced criminal defense attorney wants to learn everything he can about the case and his client in order to apply the best strategies to get the best possible results.

Some of the most important information about the client includes the following.

  • Present employment
  • Past employment
  • Military experience
  • Religious affiliations
  • Character references
  • Mental health
  • Physical health
  • Certificates of expertise
  • Educational background
  • Prior criminal record

Positive information about the client is helpful in resolving the case with the prosecutor and the judge during the court process.

Police Investigation. If the police or a detective wants to speak to you about an allegation of a hit and run, call the defense attorney for guidance.

Plea Bargaining.  Once the defense attorney has the best information about the case, which includes the full background of his client, witness statements, the evidence seized by the police and other important factors, he goes to court to negotiate a plea bargain with the prosecution and the judge.

A plea bargain is an agreement between the prosecutor, judge, defense attorney and the client to eliminate or reduce the charges, avoid or minimize the amount of time in prison or jail, and reduce the fines.

A client is under no obligation to accept a plea bargain, but it is the first stage in every criminal prosecution.

Defense Strengths. Good plea bargains come about because attorney Pflaum knows his client well, investigates the case, carefully reviews the police reports, the medical records, fingerprints, videos, photographs, accident reconstruction diagrams, the nature of the physical damages to the vehicles involved in the case, 911 calls, forensic evidence, and witness statements to develop the strengths of a case.

Prosecution Weaknesses. By the same process the criminal defense attorney develops weaknesses in the prosecutor’s case such as inconsistencies in witness statements, problems with the arrest or the investigation, discrepancies in the conduct of the investigating officers, missing or inconclusive evidence, and problems in the forensic evidence.

Effective Presentation. The criminal defense attorney then makes a persuasive presentation to the judge and prosecutor about the strengths of his client’s case, and weaknesses of the prosecution’s case, to achieve an excellent plea bargain for his client.

If the plea bargain offer is accepted by the client and his defense attorney, the case then goes to the next court date for sentencing.

If the plea bargain is not accepted then the client and the defense attorney continue to aggressively defend the case as it heads towards a jury trial.

Jury Trial. For cases that cannot be, or should not be, settled by way of a plea bargain, attorney Pflaum is ready to prepare for and go to jury trial and get the best results possible for his client.

Recent Court Victories *

1.  Client charged with felony assault, spousal abuse and criminal threats. Bail was set at $200,000. 
Attorney Pflaum convinced the judge to reduce bail to $20,000 and to allow the client to return home. 
The case was hard fought. 
The results: dismissal of all charges but for one count of misdemeanor battery.

2.  Client charged with grand theft.  Mr. Pflaum presented substantial favorable information about the client to the district attorney. 

Charge reduced to a misdemeanor disturbing the peace.

3.  Client filed a request for a temporary restraining order (TRO) due to being humiliated and harassed by the respondent. 

Attorney Pflaum resolved the case.

Our client received attorney fees from the respondent, a written apology and an extension of the TRO.

4.  Client was charged with DUI of prescription drugs. 

The DUI was dismissed. Drivers license not suspended.

5.  Client charged with a hit and run.  We arranged to make payment of damages to the victim. 

Case dismissed.
